Terms of Service

These terms govern your use of MARK. Installing it into a Slack workspace, or using it, means you accept them.

Agreement

This is an agreement between you and Marketeer sp. z o.o., registered at Żurawia 6, 00-503 Warszawa, Poland. If you are installing MARK for a company, you confirm you are authorised to accept these terms for it, and "you" means that company.

If you do not accept these terms, do not install or use MARK.

What MARK is

MARK is an AI worker that operates inside Slack. It holds context about your company and clients, drafts and runs marketing work, books creators, and tracks tasks to completion.

MARK produces drafts and takes actions on your instruction. It is not a substitute for professional marketing, legal, financial or regulatory advice, and its output is not reviewed by us before you see it.

Your workspace

You need authority over the Slack workspace to install MARK into it. You decide which channels it joins and who can instruct it, and you are responsible for those choices and for the people you give access to.

Slack’s own terms apply to your use of Slack. We do not control them and cannot waive them.

Acceptable use

You agree not to:

  • Use MARK for anything unlawful, or to produce marketing that is deceptive, discriminatory or otherwise illegal where it will run.
  • Feed it data you do not have the right to share — including personal data you have no lawful basis to process.
  • Reverse engineer, decompile, or attempt to extract the underlying models or prompts.
  • Resell, sublicense or provide MARK to third parties as a service of your own.
  • Circumvent usage limits, rate limits, or the boundaries of your plan.
  • Use it to generate content that infringes someone else’s intellectual property.

Your content and who owns what

You keep ownership of everything you put into MARK and, as between you and us, of the output it generates for you. You grant us a limited licence to host, copy and process that content strictly to operate the service for you.

We keep ownership of MARK itself — the software, the interface, the underlying systems. Nothing here transfers that to you.

AI-generated output may not be eligible for copyright protection in every jurisdiction. That is a matter of law, not something we can grant you.

AI output and your responsibility for it

Generated content can be inaccurate, out of date, or wrong about your brand, your client or your market. You are responsible for reviewing anything MARK produces before you publish it, send it to a client, or spend money on it.

You are responsible for the compliance of your own marketing — advertising standards, disclosure rules, platform policies, and any claims made in the copy. We do not check any of it.

Trial, plans and payment

Every plan starts with a 14-day free trial, no card required. After the trial you must select a paid plan to keep using MARK.

Plans are priced per workspace, not per seat, and each has a monthly work allowance. Current prices are on our pricing page. Fees are billed monthly in advance, are stated exclusive of tax, and are non-refundable except where the law requires otherwise.

We may change prices with at least 90 days’ notice before your next renewal. If you do not accept a change, you can cancel before it takes effect.

Cancellation and termination

You can cancel at any time; the cancellation takes effect at the end of your current billing period, and you keep access until then.

We may suspend or terminate your access if you breach these terms, if payment fails and stays unpaid after we ask, or if we are legally required to. Where it is reasonable to do so, we will warn you first.

After termination we delete your data as described in the Privacy Policy. Export anything you want to keep before you cancel.

Availability

We aim to keep MARK running, but we do not promise any particular uptime unless we have signed a separate service level agreement with you. We may take the service down for maintenance, and we may change or remove features.

Third-party services

MARK depends on Slack and on Anthropic and OpenAI. If they go down, change their terms, or restrict their APIs, MARK may be degraded or unavailable, and we are not liable for that.

Disclaimer

MARK is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that MARK will be error-free or that its output will be accurate.

Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, lost revenue or lost data.

Our total liability for any claim is capped at the fees you paid us in the 12 months before the claim arose.

Nothing here limits liability that cannot legally be limited — including death or personal injury caused by negligence, or fraud.

Indemnity

You will indemnify us against claims arising from your content, your use of MARK, or your breach of these terms — including claims that marketing MARK helped you produce was unlawful or infringed someone’s rights.

Changes to these terms

We may update these terms. We will post the new version here and change the date at the top, and for material changes we will notify customers before they take effect. Continuing to use MARK after that means you accept the new terms.

Governing law

These terms are governed by the laws of Poland, and disputes go to the courts of Warsaw. If you are a consumer, this does not remove rights you have under the law of the country you live in.
